These Terms & Conditions (“Terms”) govern your use of our website, [champagnelifegifts.com], and the purchase of our products and services by phone, email and in-store purchases. By accessing our site or placing an order, you agree to these Terms. Please read them carefully.

Use of Our Website

You, “The Purchaser”, must be 21 years or older to purchase any product containing alcohol for yourself or to give as a gift for, “The End User”. You, “The Purchaser” must be 21 years of age to purchase any gift containing tobacco OR cannabis themed products for yourself or as a gift for, “The End User”. You must use a valid credit card, with full authority to use it, to submit an order for products or services through our website. You must only use our products and services for lawful purposes only. We reserve the right to refuse service, terminate accounts and cancel orders at our discretion.  If you do not agree with any of these Terms and Conditions, please do not use the champagnelifegifts.com Website.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We may require additional verifications or information to complete the order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

Product Availability and Information

Champagne Life strives to keep our inventory readily available to our customers.  We strive to provide accurate descriptions, photos and details for all our offerings. However, availability may vary due to seasonal changes or supplier availability. If we run out of an item or no longer carry and item, Champagne Life reserves the right to substitute individual items for others of equal or greater value. In the rare circumstance that we run out of a product containing alcohol that is included in your order, we will notify you, so you have the option to make another selection. If you do not respond within one business day, we will replace the item at our discretion.

Request to Clean Before Use

We suggest washing any glassware or fruit that is provided in the gifts. As the items are placed in filler/crinkle, please clean at your discretion.

Gift Messages and Personalization

You are welcome to include a personalized message with your order. You agree that the message is not offensive, harmful or illegal. We have limitations on how many characters can be used for the card message. If you would like a longer message, it may be subject to an additional fee. 

Pricing and Payment

All purchases are subject to 8.38% Nevada State Sales Tax. You must pay in full by debit or credit card in advance when you submit an order through our website. Payment will be collected at the time of placing the order. Full payment must be received in advance before any goods are prepared or dispatched. If any payment is subsequently withdrawn, disputed, charged back or reversed in any way by you, you will have to pay the full amount of the sale, plus an administration fee and any additional fees incurred by Champagne Life. For corporate orders we will accept corporate checks.

• By completing a purchase, you confirm that you are authorized to use the payment method provided.

Returns, Refunds, Exchanges and Cancelations

Due to the nature of our products (perishable items, custom arrangements), all sales are final unless the product arrived damaged, the wrong item was sent or there was a quality issue attributable to Champagne Life.

To request a replacement or resolution, you must contact us no later than 48 hours from the date and time it was delivered. We will need to redeem the gift that you are requesting a resolution for. Photos of the issue are required before a solution will be offered.

We reserve the right to refuse refunds for reasons including incorrect delivery information, missed deliveries, or dissatisfaction with substituted items. Champagne Life is not responsible for undeliverable gifts or delayed deliveries (from hotel staff) at hotels. If the gift is unopened and undamaged, we may be able to accept the gift back in exchange for a restocking fee and pick-up fee if the driver must be sent to retrieve the gift.

Your order may be canceled up to 48 hours before the scheduled delivery date and time. If you attempt to cancel the order with less than 48 hours’ notice, you will not be granted a refund of any kind. There are NO refunds granted for custom orders. Any agreement by Champagne Life to accommodate a cancellation request will be conditioned upon payment of any and all costs, charges and expenses already incurred by Champagne Life to that point, and you agree that such amounts may be deducted from any payments previously made to Champagne Life. Accordingly, we encourage you to carefully check your order before submitting it. There are no cancelations available for custom orders or bulk orders of any kind.

Order Processing and Fulfillment

Orders are processed immediately after being submitted. If you need to make a change to your order, it must be provided before 9am on the date of your scheduled delivery.

Wholesale/Bulk Orders

If wholesale orders are purchased and paid in full, Champagne Life will responsibly hold the uncollected product for a total of up to (12) months from the date of purchase. Time frames for holding undelivered product are on a custom per order basis.  Champagne takes pride in getting your order out as soon as possible. Please understand that orders containing promotional products, custom labeling and other customizations, can take up to (15) business days to complete since it goes through several reviews before being produced.

You can anticipate (3-5) days for manufacturing and delivery for orders of 5-20 units. For orders of 20+ units, you can expect 5-10 business days for processing and delivery. Rush Orders are available at an additional cost.

Personalized Quotes

The prices displayed on this Website are quoted in U.S. Dollars and are valid and effective only in the United States. You will be responsible for all applicable taxes, shipping and fees, regardless of the amount quoted on this Website at the time of your order. Custom price quotes prepared by Champagne Life are valid for (30) days unless otherwise stated by Champagne Life. Corporate clients may receive quotes that are exclusively for that company ONLY. Champagne Life reserves the right to price products on a client-by-client basis. Champagne Life maintains ownership of all quotes, products and ideas created by Champagne Life.

Product Samples

In the situation that Champagne Life allows a client or company to hold product samples for viewing purposes, the party in possession of the samples are responsible for returning the samples undamaged by the return date mentioned in the invoice that is issued at the time of acceptance. If the samples are returned damaged or if any of the items are lost/stolen, the party in possession is financially responsible for replacement of goods within (14) days upon return.

Gratuity

At checkout, you are asked if you would like to add gratuity to your order. If added, the gratuity will be split between Champagne Life Staff and hotel staff if applicable.

Shipping

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or events outside our control. Please ensure all delivery information is accurate. Orders shipped to incorrect addresses provided by the customer are not eligible for refunds.

Alcohol-containing baskets:
If your gift baskets include alcohol, you must comply with all applicable age-verification laws. We require proof that the recipient is 21+ at time of delivery. The shipping carrier will scan the recipients ID at the time of delivery.

Local Delivery

Orders placed for local delivery are guaranteed by 6pm on the date that is selected for delivery. We offer the courtesy of allowing a requested time to be noted at the time of order. We will try our best to accommodate the selected delivery time, although we do not guarantee specific delivery times.  Once the gift has been delivered to the appropriate location, the delivery person will contact the buyer to confirm. If being delivered to a hotel or business, we are not responsible for delays associated with the hotel or business getting the gift delivered. We suggest contacting the hotel or business once the gift is delivered to ensure timely delivery. The driver will text the recipient if it is a hotel delivery. If the recipient does not receive the gift from the hotel staff for any reason, we are not financially responsible. In certain situations, Champagne Life will issue a restocking fee and refund the remaining balance, depending on the order and situation.

• If a recipient is unavailable at the time of delivery, additional delivery attempts may incur fees. If the hotel guest has changed hotels after the gift has been delivered, there will be an additional delivery fee to bring it to the correct location.

Local Delivery (Business and Residential): $19.99

Curbside Pick-Up

The person picking up the gift must be 21 years old and bring proof of ID. If the person picking up the gift is different than the buyer, please let us know in advance the persons name and phone number. Pick-up orders must be picked up within 7-days from the purchase date or they will be canceled without a refund.

In-Store Shopping

Customers shopping in store must show photo ID to be scanned at time of purchase. All in-store purchases are final sale. We only accept debit and credit card in-store, no cash.

Copyright Policy

You agree that you own or license the copyright (or are authorized by the copyright owner to send to us and use) any content or images you submit to us for custom work, and you warrant that none of the content or images contain anything which would infringe on any copyright, trademark, design right or other intellectual property right of any third party. We will not check the content of any images provided by you. However, if we believe any image does not comply with these terms, we reserve the right to refuse to use it, without any obligation or liability to you. We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of or locate anyone sending any material in breach of these terms. Champagne Life may ask you to complete the image authorization form.

Images sent to us remain under the existing copyright. By sending us an image you are granting us a license to modify, print, or otherwise use the image in accordance with the details of your order. By placing an order and accepting these terms you are accepting any and all liability for any consequences of Champagne Life using the images you supply.

For companies or organizations providing corporate logos or trademarked images, it is your responsibility to ensure that any material supplied in any medium is not protected by any copyright law, or that any necessary permission for Champagne Life to reproduce the images has been obtained.

We may photograph products that we provide to you, including those decorated with a logo or other artwork supplied by you. In addition to products we create, we may take photos at events we host and attend. We may display these photographs on our website or other advertising media, for Champagne Life’s marketing and promotional purposes, unless specifically requested in writing by you not to do so.

Champagne Life reserves all rights to logos, product images, product menus, marketing materials, graphic designs, basket contents and display, website site text, website format and website layout. Champagne Life Gifts also holds registered trademarks for our product collection. Any violation of use including usage of any kind without written consent from Champagne Life Luxury Gifts Attorney is subject to breaking Nevada State Law. You may not copy, modify, reproduce, or distribute our content without written permission. By using any of the items listed above without written consent from our Owner’s Attorney can result in litigation and damages.

Indemnification

You agree to defend, indemnify and hold Champagne Life, its employees, owners, and partners from any claims, liabilities, damages, or expenses resulting from your use of our website or violation of these Terms.

Warranty and Limitation of Liability

Champagne Life recommends the product be given to the end user within (15) days to ensure freshness. Champagne Life warrants that it has the right to provide its products but otherwise the goods are provided on an “as-is” basis, without warranty of any kind, express or implied, oral or written. In particular, but without limitation, no warranty is given that the goods are suitable for the particular purposes intended by you. To the fullest extent permitted by applicable law, Champagne Life shall not be liable for any claim arising out of the performance, non-performance, indirect, incidental, or consequential damages, allergic reactions or adverse effects from product ingredients (customers are responsible for checking product details and allergens), delay in delivery of or defect in the goods, nor for any special, indirect, economic or consequential loss or damage however arising or however caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning, or use of the goods sold by Champagne Life. Your use of our website and products is at your own risk.

Changes to Terms

We may update these Terms at any time. Changes will be posted on this page, and the “Last Updated” date will be revised. Continued use of the website constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles

General Terms of Use:

You agree that: (i) the services being provided and goods sold by Champagne Life shall be deemed solely based in Las Vegas/Henderson; and (ii) the Website shall be deemed a passive website that does not give rise to personal jurisdiction over Champagne Life, either specific or general, in jurisdictions other than Nevada. These Terms and Conditions shall be governed by the internal substantive laws of the State of Nevada, without respect to its conflict of laws principles. Any claim or dispute between you and Champagne Life that arises in whole or in part from your use of the Website shall be decided exclusively by a court of competent jurisdiction located in Las Vegas, Nevada. These Terms and Conditions, and any other legal notices published by Champagne Life on the Website, shall constitute the entire agreement between you and Champagne Life regarding your use of Champagne Life’s Website. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and Champagne Life’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. Champagne Life reserves the right to amend these Terms and Conditions at any time and without notice, and it is your responsibility to review these Terms and Conditions for any changes. Your use of the Website following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms. YOU AND CHAMPAGNE LIFE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITE OR ANY OTHER MEDIUM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
